Legal Dimensions and Weights
Standard Legal Limits
- Single axle: 21,000 lbs
- Tandem axle: 34,320 lbs
- Gross vehicle weight: 80,000 lbs maximum
For Divisible Loads
- Gross vehicle weight: 80,000 lbs maximum (including load)
- Single axle: 22,400 lbs
- Tandem axle: 36,000 lbs (axles less than 8' apart)
Permit Types and Costs
Special Hauling Permits (Non-Divisible Loads)
- Permit service fee: $40.00
- Note: Fees do not include any applicable permit service charges
Bonding Requirements:
- Per move: $10,000 surety bond
- Per company: $25,000 surety bond
Annual Roadwork Vehicle Permit:
- Cost: $360
72-Hour Trip Permit
- Cost: $25.00
- Duration: 72 hours
Divisible Load Overweight Permits
If combining permit types:
- Highest base fee applies
- All other additional permit types: $65.00 each
Trailer Fees:
- Trailer Option I: $20.00 per trailer (excluding the first one)
- Trailer Option II: $10.00 per trailer (including the first and any trailers added after permit is issued)
Seasonal Agricultural Permits:
- Cost: ½ the annual fee listed
- Duration: Valid for 4 consecutive months
- Limited to: Types 1, 1A, 7, and existing Type 8 permits
NY Thruway
- 12-month fee to OSCAR Escrow accounts: $100.00

Escort Vehicle Requirements
No Escort Required
- Oversized loads less than 12' wide, 80' long, and 14' high
- Exceptions requiring escort even if under these limits:
- Slow-moving vehicles
- Bridge speed restrictions
- Overhangs greater than 10'
Front Escort Required
On two-lane roads when load:
- Exceeds 12' wide, AND/OR
- 80' long or greater, AND/OR
- Height of 14' or greater
For overheight vehicles:
- Front escort must be equipped with height pole
- Height pole must be 3 inches higher than overall height of permitted vehicle/load
Rear Escort Required
On highways with more than two lanes when:
- Load greater than 12' wide
- 80' long or greater, OR
- Vehicle is slow-moving, OR
- Bridge speed restrictions required, OR
- Overhang greater than 10'
Police Escort Required
- Over 16' height
- Over 200,000 lbs weight
- If load cannot maintain normal highway speeds
Route Survey Requirements
Required for vehicles/loads exceeding:
- 13'11" high
- 100' long
- 16' wide
Important: Route surveys must be physically performed by New York State-certified escorts
Certification Requirements
- New York requires P/EVO certification
- No reciprocity: Only NY-certified P/EVOs allowed
- Route surveys must be performed by NY State-certified escorts
Transport Vehicle Requirements
Warning Signs
Required for vehicles/loads:
- Greater than 12' wide, OR
- Longer than 65'
Sign specifications:
- Dimensions: 7' long x 18" high
- Letters: 10" high, black
- Background: "Highway Yellow"
- Placement: Front and rear of vehicle
Flags
- Color: Red or orange fluorescent
- Size: 18" square
- Placement: Extremities and any protrusions
Operating Times
Standard Permitted Hours
- Weekdays: Daylight hours (1/2 hour before sunrise to 1/2 hour after sunset)
Saturday Travel (Non-Holidays)
Loads within 12' width and 85' length:
- 1/2 hour before sunrise to 12:00 noon
Overweight Only Loads
Within 125% of legal weight:
- No time/day restrictions

Penalties and Fines
NYC-Specific Enforcement (2025)
BQE WIM (Weigh-In-Motion) System:
- Enforcement began: June 22, 2025 (Staten-Island-bound traffic)
- Fine: $650 per violation for overweight trucks
- 90-day warning period: Began March 2025
New York State Overweight Fines (VTL 385-8)
Fine structure based on percentage over weight limit:
Up to 2% over:
- Minimum fine: $150
Up to 38% over:
- Minimum fine: $3,750
Over 40%:
- Base fine: $3,750
- Plus: $125 for each additional percent over 40%
Permit Violations
CRITICAL: If truck weight exceeds maximum weight granted in permit, New York law may treat it as if no permit was ever issued
Example:
- Load was 30,000 lbs with permit for 20,000 lbs (10,000 lbs over)
- Without permit treatment: $3,200 fine
- With permit treatment: $1,200 fine
Oversized Load Penalties
First-time violations:
- Fine range: $250 to $500
Exceeding weight limits:
- Maximum fine: Up to $5,000 per violation
